"Curry said that his office would "vigorously prosecute" the case, according to the AP".

Police said Jackson, who grew up in Atlanta, and Uber driver Jeffrey Monroe, 54, were standing outside Monroe's vehicle along I-70 after Jackson became ill while Monroe was transporting him for the ride-hailing company.

"We are disheartened that ghoulish and inappropriate public commentary has politicized this tragedy", Curry, a Democrat, said in a statement.

Monroe and Jackson were pronounced dead at the scene by the Marion County Coroner's Office. "We will simply seek justice on behalf of the families of those two victims". "We must get the Dems to get tough on the Border, and with illegal immigration, FAST", Trump tweeted. Orrego-Savala, 37, remained jailed Tuesday but had not been formally charged in Sunday's crash along Interstate 70 in Indianapolis.

A little more than two years later, in March 2009, he was again arrested in San Francisco and then deported that May.

Additionally, he has also been charged with "illegally reentering the country after being deported".

Orrego-Zavala's defence attorney, Jorge Torres, said in an interview on Wednesday that his client's immigration status was irrelevant to the case.

"It's really not an immigration story at all". He tried to flee the scene but was arrested by a responding officer on a nearby exit ramp, according to Indiana State Police.

"He's very distraught to say the least", Torres said.

Trump tweeted about the case Tuesday, saying it's "so disgraceful" that Jackson was killed by a person who was in the USA illegally. "This obviously happened so unexpectedly", Atlanta attorney Daniel Meachum said. "We are shocked and saddened by this tragedy, and our thoughts and prayers are with the families of both men during this hard time".

Jackson, 26, and Monroe, 54, were standing outside Monroe's vehicle along Interstate 70 in Indianapolis after Jackson became ill while Monroe was transporting him for the ride-hailing company, police said. Investigators believe Monroe had pulled over and exited the auto to assist Jackson, who had become ill.

Wednesday's announcement came after Orrego-Savala was charged Tuesday in a federal criminal complaint with illegal re-entry of a previously deported alien.

Orrego-Savala's blood alcohol level was 0.239 percent-nearly three times the legal limit in Indiana-reports the Indianapolis Star, citing a preliminary probable cause affidavit filed in Marion County Superior Court.

Orrego-Savala told an Indianapolis judge Tuesday, through an interpreter: "I wasn't driving the vehicle".

Federal immigration officials declined to comment Tuesday beyond noting in a statement that Orrego-Savala had a 2005 drunken driving conviction in Redwood City and numerous misdemeanor arrests and convictions in California and Indiana.

Manuel Orrego-Savala, a citizen of Guatemala, leaves a court hearing Tuesday, Feb. 6, 2018, in Indianapolis.

After the crash Sunday, Orrego-Savala was accused of driving without a license and suspicion of intoxicated driving, and taken to the Marion County Jail.

IN prosecutors are seeking a DNA sample from the Guatemalan man charged in a drunken-driving crash that killed Indianapolis Colts linebacker Edwin Jackson and an Uber driver.
